In a major relief to Aam Aadmi Party (AAP), the Delhi High Court on Friday set aside the Presidents notification that disqualified its 20 MLAs and asked Election Commission (EC) to continue the hearing from where it had last stopped.

Unlike the Karnataka High Court's judgment on Hegde's disqualification when the matter had been put an end after the court judgment, this time the Delhi High court referred the matter to the Election Commission to hear it again as it did not hear the side of AAP MLAs.

The notification issued on January 21 on the office of profit complaint against 21 MLAs was a stinging rebuke on the AAP government, as the Election Commission opinion that formed part of the document said it was done through "flagrant violation" of Constitution that only permits a maximum of 10% MLAs to be appointed as ministers.

Congress leader Ajay Maken said AAP's celebrations were premature.

"We even sent to each of these MLAs, very detailed documents given to us by the Delhi government on the work done by them as parliamentary secretaries". He later met the 20 AAP MLAs.

The Delhi High Court on Friday asked why the Election Commission had not informed the AAP MLAs, facing disqualification proceedings, about the decision of one of the then commissioners, O.P. Rawat to rejoin the Presidential reference proceedings after his recusal earlier previous year. HC has not disputed or denied this.

Delhi Assembly Speaker Ram Niwas Goel on Friday said he would allow the 20 AAP MLAs, embroiled in the office-of-profit controversy, to attend the ongoing Budget session in the wake of the high court setting aside their disqualification in the case.
